Before submitting a PPH request to the CNIPA, the applicant needs to prepare the relevant information and the documents corresponding to the patent application (hereinafter referred to as the necessary annexes) in accordance with the requirements in the “Request Form for Participating in the Patent Prosecution Highway (PPH) Project Pilot” (hereinafter referred to as the PPH Request Form).
The necessary annexes include a copy of the claims of the corresponding patent application and a translation thereof (i.e. “Copies of all claims identified by the OEE (earlier examining office) as grantable and their translations if required” in the PPH Request Form), a copy of the office action of the corresponding patent application and its translation (i.e. “OEE work results and their translations if required” in the PPH Request Form), and copies of the cited documents in the office action of the corresponding patent application (i.e. “Documents cited by OEE work results” in the PPH Request Form).
