Weekly IP News – Required Documents and Examination Period for Handling an Assignment of Chinese Trademark

Documents required for an assignment of Chinese trademark:

1. An application form stamped or signed by both the assignor and assignee.

2. The Transfer Agreement signed or stamped by both the assignor and assignee.

3. Qualifications stamped or signed by both the assignor and assignee, e,g, business license or passport for foreign applicant.

4. Notarization is not a mandatory document for an assignment of Chinese trademark. However, in some cases, the applicant may be required to submit a notarized document during the process of examination. For example, if the assignor files a transfer application that is not a true intention or due to bad faith, the examiner may issue an office action requesting both the assignor and assignee to submit a notarized Transfer Agreement.
